The At-Fault Driver's Insurance Verses Your Own Insurance
Whether you are involved in an auto accident, trucking accident or a motorcycle accident, one of the first things your lawyer should do is analyze what insurance is available. In order to make a full recovery, your lawyer must identify the amount of insurance available from the at-fault driver's insurance company, and the insurance that is available from your own insurance. This includes uninsured coverage (UM), under-insured coverage (UIM), and medical payments (Med Pay) coverage.
For example: If an at-fault driver has the North Carolina minimum limit of thirty thousand dollars ($30,000.00) in liability coverage and you have an under-insured motorist (UIM) policy on your motorcycle of fifty thousand dollars ($50,000.00), and an additional policy on your personal car or truck of fifty thousand dollars ($50,000.00), then you will have an under-insured motorist coverage of up to one hundred thousand dollars ($100,000.00), because your two policies combined meet that amount. Under this scenario, you may be able to recover thirty thousand dollars ($30,000.00) from the at-fault party and as much of $70,000.00 from your own UIM policies to equal the maximum amount of one hundred thousand dollars ($100,000.00) under your policies, if your injuries and lost wages warrant such a recovery.
Your auto insurance policy may also contain a provision for Med Pay coverage. If you are injured in an auto accident, Med Pay can be used to pay your medical bills regardless of whether you or the other driver was at fault. This coverage is used to bridge the gap between the time of injury and the time when you are able to go back to work. At the law firm of Hemmings & Stevens, PLLC, it has always been our policy to recover your Med Pay benefits with out any cost or lawyer fees.
